2. Scope of ServicesWe provide:Custom software development tailored to your needs.
Consultancy services to assist with strategy, implementation, and optimization.
Devrel services to assist with developer marketing.Details of deliverables, timelines, and fees will be outlined in a formal agreement or project proposal.

3. Fees and PaymentAll fees will be specified in the project agreement.
Payments are due as per the milestones or timeline outlined in the agreement.
Late payments may incur a penalty of 10% per month.

4. Client ResponsibilitiesYou agree to:Provide all necessary information, resources, and access to facilitate the work.
Respond promptly to communications and feedback requests.Failure to do so may delay the project timeline.

5. Intellectual PropertyOwnership of the final deliverables will transfer to you upon full payment.
We retain the right to showcase non-confidential parts of the project as part of our portfolio, unless otherwise agreed.
Any pre-existing intellectual property remains the exclusive property of the party that owns it.

6. ConfidentialityBoth parties agree to keep any confidential information shared during the project secure and not disclose it to third parties without written consent.

7. Liability and WarrantyWe warrant that our services will meet the agreed-upon specifications.
However, we are not liable for:
Indirect or consequential damages.
Issues arising from third-party tools, libraries, or platforms used in the project.
Post-delivery support or bug fixes may be subject to additional fees unless otherwise included.

8. TerminationEither party may terminate the agreement with a written notice of 10 days.
In the event of termination:
Work completed up to that point will be invoiced.
Any prepaid fees for uncompleted work will be refunded proportionately.

9. Governing LawThis agreement will be governed by the laws of India.

10. AmendmentsWe reserve the right to update these terms. Any significant changes will be communicated to you.

Cancellation and Refunds

1. Cancellation by the ClientYou may cancel our services by providing written notice via email or another agreed-upon communication method. The terms for cancellation are as follows:Before Project Commencement:
If you cancel before the project begins, you will receive a full refund of any upfront payments, minus administrative charges (if applicable).After Project Commencement:
If cancellation occurs after the project has started, you will be charged for all work completed up to the cancellation date, including any non-recoverable expenses incurred.
Any remaining balance from upfront payments will be refunded.Ongoing/Subscription Services:
For recurring or subscription-based services, cancellation must be requested at least 10 before the next billing cycle to avoid being charged for the upcoming period.

2. Cancellation by Aniket BhattacharyeaWe reserve the right to cancel services under the following conditions:Non-payment of fees as agreed in the project contract.
Breach of our Terms and Services.
Unforeseen circumstances that prevent us from fulfilling the contract.In such cases:You will receive a refund for any unused portion of the services, minus charges for completed work and expenses.

3. Refund PolicyRefunds will be processed as follows:Non-Tangible Deliverables:
For consultancy services or advisory work, refunds will not be provided once the service has been delivered.Tangible Deliverables:
For software development projects, refunds will only apply to unused milestones or incomplete deliverables, as outlined in the project agreement.Upfront Payments:
Upfront payments are refundable only if the project is canceled before commencement, subject to administrative fees.

4. Exceptions to RefundsRefunds will not be provided for:Delays caused by the client, including unresponsiveness or lack of required inputs.
Change of mind after substantial progress has been made on a deliverable.
Work already approved by the client.

5. Process for Cancellation and Refund RequestsTo request a cancellation or refund:Send an email to [email protected] with the subject line “Cancellation Request” or “Refund Request.”
Include your project name, invoice number, and the reason for the request.
Refunds will be processed within 10 of approval and issued through the original payment method.
